Conditions of Sale and Limited Warranty

1. Payment

Customer agrees that payment shall be made by credit card at the time the order is placed or COD at the time of delivery. Returned checks and credit card chargebacks will incur a $35 fee. Customer agrees to pay all reasonable attorneys fees and expenses incurred by Smart Miles, Inc. to collect debts owed to Smart Miles, Inc. by Customer.

2. Refunds/Returns/Replacements/Cores

All orders are electronically processed and forwarded to the warehouse immediately after the order is confirmed. Therefore, the window of opportunity to cancel an order is limited. All orders must be canceled BEFORE the Customer receives electronic confirmation of the order and payment. No orders can be canceled after payment has been confirmed, as the order will be immediately processed for shipment. All orders placed from Friday after 5PM EST – Monday 9AM EST cannot be canceled, as they are processed over the weekend for shipment.

Smart Miles, Inc. does not make cash refunds.

Smart Miles, Inc. may issue the Customer a credit for returned items or ship a replacement part if and to the extent allowed by this paragraph.

The Customer is responsible for ordering correct parts. A store credit will be issued to the Customer if the Customer orders incorrect parts and returns the incorrect parts unused to Smart Miles, Inc. within 10 days.

Smart Miles will accept returns of new and used auto parts (excluding the cost of shipping) returned in original condition and packaging for 10 business days from the date you receive your item. All items returned after 10 business days will incur a 20% re-stocking fee. No returns will be accepted after 30 days. Returns must include all components and cannot be disassembled or damaged due to incorrect installation. Returns missing components will not be credited.

Sales of Electric bicycles, mopeds and scooters are final. Smart Miles, Inc. will not accept returns on these items.

Smart Miles, Inc. reserves the right to inspect any product for which the Customer requests replacement.

Replacement of a defective part will be processed only if it is accompanied by the original sales invoice.

Some of the parts sold by Smart Miles, Inc. are remanufactured. For parts like alternators and master cylinders, the basic body (a complex and expensive metal casting) usually is very durable. But components like bushings and seals can wear out and cause the part to fail. Replacing just the worn components can be very cost-effective, helps protect the environment, and produces very reliable results. Remanufactured parts usually have a core charge. The “core charge” is a deposit that the manufacturer charges Smart Miles, Inc., which is then passed on to the Customer. The Customer pays the core charge when placing an order. If the Customer returns the old part to Smart Miles, Inc., the Customer will receive a refund of the core charge. To receive credit, cores (except for complete engines and transmissions) must be returned within 10 days from the date the Customer placed the order, except that complete engine and transmission cores may be returned within 14 days from the date the Customer receives delivery. Cores must be complete, rebuildable, fit the same vehicle application and be returned in the box the remanufactured part came in. This means the part the Customer sends back needs to have whatever components (like pulleys) came on the remanufactured part. The box helps identify the part and proves to the manufacturer that the core replaces one of their products. The core cannot be smashed, rusted solid, etc. or otherwise unusable.

3. Risk of Loss

Absent express, written agreement by Smart Miles, Inc. to the contrary, the Customer pays the shipping costs for all items purchased from and/or returned to Smart Miles, Inc. The Customer agrees that regardless of which party pays for the shipping costs, the risk of loss and title of any item is assumed by the Customer when the carrier accepts the goods for transport.

4. Warranties

EXCEPT AS SET FORTH BELOW, SMART MILES, INC. EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF TITLE, OR IMPLIED WARRANTIES OF MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMISSIBLE BY LAW.

a. New and Used Auto Parts LIMITED WARRANTY

This “LIMITED WARRANTY” by Smart Miles, Inc. is given to the owner of the vehicle at the time the part was purchased or (if applicable) to the shop performing the repair for said owner. This warranty is not transferrable. Parts that fail within 90 days after the date of purchase will be repaired, replaced, or the purchase price will be refunded at the option of Smart Miles, Inc. The replacement period begins from the original date of purchase as indicated on the original invoice if a failure occurs and a replacement is made. Any agreement to extend the warranty period must be in writing.

This LIMITED WARRANTY excludes:

  • Breakdowns caused by non-covered components, improper installation, defective workmanship, usage for which the part was not intended and/or improper maintenance (i.e. using the incorrect types and levels of fluids and lubricants as outlined in the owner’s manual).
  • Windshield and other glass breakage.
  • Freight costs or similar damages.
  • For purchases of engines, any and all defects except for defects in the block, heads, pistons, crankshafts, camshaft rockers and oil pumps. All other parts that may be provided are deemed “Accessories and Extra Parts.” No warranty is provided for any such parts that are attached including parts such as switches, sensors, cables, electronics, belts, hoses, water pumps and manifolds. Claims related to the overheating and/or improper lubrication of the engine or its components are not covered .
  • All airbags and components, which are sold “AS IS”.
  • All suspension parts, which are sold “AS IS”.
  • All electrical parts, which are sold “AS IS”.
  • The part is sold “AS IS”.

This LIMITED WARRANTY is null and void if:

  • The vehicle is converted from private passenger use to commercial or fleet use, or is used for racing or other competition or off-road recreational purposes.
  • Installed in an application for which the original manufacturer did not intend it.
  • Failure is caused by abuse, misuse or modifications.
  • Failure is caused by towing a trailer or other vehicle unless the vehicle is equipped for this purpose as recommended by the manufacturer.
  • The vehicle has been modified to plow snow, whether the snowplow is attached to the vehicle or not.
  • The part fails or becomes defective due to the vehicle being involved in a collision.
  • The installed heat tab center is melted or removed.
  • The part is sold “AS IS”.
  • The vehicle is not serviced at proper intervals or use of fuel/oil/coolant is not in accordance with the original manufacturer’s specifications.
  • The vehicle’s engine oil and filter have not been replaced every 4,000 miles and documentation of such replacement is not provided to Smart Miles, Inc.
  • Failure is caused by or related to a collision, fire, theft, vandalism, riot, explosion, lightning, earthquake, windstorm, hail, water, freezing or flood.
  • Any “Recommended Installation Procedures” provided by Smart Miles, Inc. are not followed by the installer.

Important Notices That May Affect the Customer’s Limited Warranty

  • The Customer must use all reasonable means to protect the product from further damage and must return the original defective product to Smart Miles, Inc. The Customer must furnish Smart Miles, Inc. with such information as Smart Miles, Inc. may reasonably require, including proof of the vehicle’s regular maintenance as recommended by the manufacturer in the owner’s manual.
  • Smart Miles, Inc. is not responsible for securing products or insuring security on the Customer’s vehicle.
  • If any part sold hereunder has a Vehicle Identification Number (“VIN”) on it, the installer must obtain a replacement VIN for such part to the extent necessary to comply with all applicable laws.
  • Timing belts, thermostats, spark plugs, fluids and seals are routine maintenance items and should be replaced at the time of installation and at the manufacturer’s recommended service intervals. Refer to the Manufacturer’s “Owner’s Manual” of your vehicle for correct operation and maintenance schedule.
  • Proper operation of the cooling and electrical system must be checked during installation of products that can be affected by those systems.
  • While most fluids have been drained from Smart Miles, Inc. products, it is the installer’s responsibility to completely drain and replace fluids, lubricants, antifreeze, and filters with replacements that are fresh, clean and approved by the Original Equipment Manufacturer (OEM).
  • The year and model of the vehicle or part printed on the Smart Miles, Inc. invoice is within a range of interchangeability and may not necessarily be the exact model and year as the part or vehicle that has been provided by Smart Miles, Inc.
  • An auto part may have accessories that are attached which must be switched or removed to accommodate proper installation of the part, which is the responsibility of the installer. Such accessories have been included to aid in the convenience of installation and are not covered by this warranty.
  • It is the responsibility of the installer to replace the radiator or transmission oil cooler, flush the transmission oil cooling lines, fill differential, adjust shifter mechanisms, replace filters, replace seals, replace pan gaskets and reset or replace computer codes when installing a transmission.

b. Used Cars

SMART MILES, INC. EXPRESSLY DISCLAIMS ANY WARRANTY FOR USED CARS, INCLUDING BUT NOT LIMITED TO A WARRANTY OF MERCHANTABILITY. Absent express, written agreement by Smart Miles, Inc. to the contrary, Smart Miles, Inc. does not provide any warranty on used cars purchased by the Customer from Smart Miles, Inc. Refer to your Owner’s Manual and/or Buyer’s Guide for manufacturer’s warranty information which may be applicable to the vehicle.

c. Electric Bicycles, Mopeds, Scooters and Accessories

Smart Miles, Inc. provides manufacturer warranty service for all of the models sold by Smart Miles, Inc. However, Smart Miles, Inc. does not provide a warranty on these items (see the disclaimer below). Refer to your Owner’s Manual and/or Buyer’s Guide for manufacturer’s warranty Information which may be applicable to these items.

SMART MILES, INC. EXPRESSLY DISCLAIMS ANY WARRANTY FOR ELECTRIC BICYCLES, MOPEDS, SCOOTERS AND ACCESSORIES, INCLUDING BUT NOT LIMITED TO A WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

5. Limitation of Liability.

TO THE FULLEST EXTENT PERMISSIBLE BY LAW, IN NO EVENT AND UNDER NO CIRCUMSTANCES SHALL SMART MILES, INC. OR ANY OF ITS OWNERS, OFFICERS, MANAGERS, DIRECTORS, EMPLOYEES, AGENTS OR REPRESENTATIVES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR OTHER DAMAGES (REGARDLESS OF THE FORM OF ACTION AND EVEN IF SMART MILES, INC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES ), INCLUDING WITHOUT LIMITATION ANY SUCH ACTION ARISING OUT OF: (I) USE OF THE ITEMS PURCHASED FROM SMART MILES, INC., INCLUDING BUT NOT LIMITED TO, ANY DAMAGE CAUSED BY ANY RELIANCE ON, OR ANY DELAYS, INACCURACIES, ERRORS OR OMISSIONS IN, ANY INFORMATION PROVIDED BY SMART MILES, INC., (II) INSTALLATION OF THE ITEM(S) PURCHASED FROM SMART MILES, INC., OR (III) LOST OR STOLEN PACKAGES MAILED TO SMART MILES, INC. BY THE CUSTOMER WHICH CONTAIN ITEMS BEING RETURNED TO SMART MILES, INC. FOR ANY REASON. IN NO EVENT SHALL SMART MILES, INC.’S CUMULATIVE LIABILITY FOR ANY AND ALL CLAIMS RELATING TO ITEMS PURCHASED BY THE CUSTOMER FROM SMART MILES, INC. EXCEED THE TOTAL AMOUNT THAT THE CUSTOMER PAID TO SMART MILES, INC. FOR THE ITEM(S) UPON WHICH THE CUSTOMER’S CLAIM IS BASED.

6. Miscellaneous

These Conditions of Sale and the relationship between the parties shall be governed by the laws of the state of Florida without regard to its conflict of law provisions. The parties agree to submit to the personal and exclusive jurisdiction of the state or federal courts located in Broward County, Florida. Smart Miles, Inc.’s failure to exercise or enforce any right or provision under these Conditions of Sale shall not constitute a waiver of such right or provision. If any provision of these Conditions of Sale is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and agree that the other provisions of these Conditions of Sale remain in full force and effect. The Customer agrees that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to items purchased from Smart Miles, Inc. subject to these Conditions of Sale must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in these Conditions of Sale are for convenience only and have no legal or contractual effect. We reserve the right to correct typographical and printing errors. We reserve the right to correct prices or calculation errors. The waiver of a breach or default under these Conditions of Sale shall not be interpreted to constitute waiver of any subsequent breach or default, and shall not act to amend or negate the rights of the parties hereto. Smart Miles, Inc. is able to ship products outside of the United States and welcomes Customers throughout the world. PLEASE BE ADVISED: if your vehicle was built for a different market, use caution when ordering. Even though Smart Miles, Inc.’s return policies apply equally to US and international orders, shipping international returns can be expensive. If taxes or other import fees are due for a shipment, the carrier may ask you to pay them when your order is delivered. To avoid surprises, please contact your local customs office before placing an order to ask what charges may apply. Smart Miles, Inc. adds sales tax to orders shipped to destinations in the state of Florida. Tax-exempt Customers need to provide Smart Miles, Inc. with a copy of a state resale certificate, exemption certificate, or other acceptable proof of exempt status. Customers are responsible for the payment of any sales or use tax on orders shipped to destinations outside of the state of Florida.
